How the Military Appeals Process Works

In some cases, a court-martial conviction will result in an automatic review by the appropriate military court of appeal.

This occurs when the sentence includes:

  • Bad conduct discharge
  • Dishonorable discharge
  • Officer dismissal
  • At least one year in prison
  • Death

If your sentence does not include any of the above penalties, you may still request an appeal with the military court of appeal for your branch or, in certain circumstances, you may petition the Judge Advocate General’s (JAG) Corps for a review by the appeals court. If the appeals court denies your request for a review, you can request that your case be heard by the JAG directly.

If the appeals court does grant your request for a review, it will begin looking at various factors of your conviction and sentence. These factors typically include:

  • Whether your guilt was proven beyond a reasonable doubt
  • Whether legal errors were made during the court-martial or related proceedings
  • Whether you pled guilty and, if so, whether you indicated at any time that you believed yourself to be innocent
  • The sentence you received and whether it is appropriate

If your appeal is successful, you may have your sentence reduced or your case dismissed altogether. If it is not successful, however, you may wish to appeal your case to the Court of Appeals for the Armed Forces. In all cases not involving a death sentence, your attorney must file a petition on your behalf in order to appeal to the Court of Appeals for the Armed Forces. This petition will need to prove that there is “good cause” for your appeal.
